Provision Of Companies in Malaysia

A company is an organization or enterprise formed by a group of people, usually for the purpose of carrying on business. In Malaysia, companies are regulated by the Companies Act 1965.

The Companies Act 1965 provides for the incorporation of companies and the regulation of their internal affairs. It also sets out the requirements for the registration of companies and the filing of annual returns.

Under the Companies Act 1965, a company must have at least two directors and a secretary. The directors must be natural persons aged 18 years or older. The secretary must be a natural person or a body corporate.

A company must have a registered office in Malaysia. The registered office must be open to the public during normal business hours.

A company must file its annual return with the Registrar of Companies within 42 days of the end of its financial year. The annual return must contain financial statements and other information prescribed by the Companies Commission of Malaysia.

The Companies Act 1965 also provides for the registration of charges and the appointment of receivers.
