To Carry On Business As Private Employment Agency Companies in Malaysia

Carry on business as a private employment agency company in Malaysia is subject to the Private Employment Agencies Act 1981 (Act 366). The registration of private employment agencies is under the jurisdiction of the Ministry of Human Resources.

A private employment agency company is defined as a company which carries on business with a view to providing employment for workers and which includes an employment agency.

The objectives of the Private Employment Agencies Act 1981 are to regulate the registration of private employment agencies and to provide for the protection of workers employed by private employment agencies.

The Act requires that all private employment agencies be registered with the Ministry of Human Resources. A private employment agency company must apply for registration within 14 days of its incorporation.

The registration of a private employment agency company is valid for a period of one year and is renewable annually.

A private employment agency company must display its registration certificate at its premises.

A private employment agency company is required to maintain a register of workers employed by the agency. The register must contain the following information for each worker:

- name
- age
- sex
- nationality
- last education level attained
- employment history

A private employment agency company is prohibited from:
