To Transact Companies in Malaysia

Transact company is a company which is involved in the business of buying and selling of goods and services. In Malaysia, the company is required to be registered with the Companies Commission of Malaysia (SSM) in order to operate legally. The company must also comply with the requirements of the Companies Act 1965.

Under the Companies Act 1965, a company is defined as "a company formed and registered under this Act or an existing company". An existing company is defined as "a company formed and registered under any written law in force in Malaysia immediately before the commencement of this Act".

A company may be either a public company or a private company. A public company is a company which:

(i) is a company limited by shares;

(ii) is a company limited by guarantee and having a share capital; or

(iii) is an unlimited company,

and which is not a private company.

A private company is a company which:

(i) is limited by shares;

(ii) is limited by guarantee and having a share capital; or

(iii) is an unlimited company,

and which has the following characteristics:

(a) its articles of association prohibit
