The Company wishes to announce that Kilang Bihun Bersatu Sdn Bhd (“KBBSB”) and EKA Foodstuff Sdn Bhd (“EFSB”), both being the wholly-owned subsidiaries of EKA had, on 03 February 2020 respectively been served with an Amended Writ of Summon dated 15 August 2019 and an Amended Statement of Claims dated 15 August 2019 issued by the High Court of Malaya at Kuala Lumpur in relation to the claims filed by the Plaintiff through a firm of lawyers acting on their behalf.
KBBSB and EFSB are required to file a Memorandum of Appearance within 14 days from the date of service of the documents, failing which, a Judgement in Default may be entered against KBBSB and EFSB.
Particulars of claims and circumstances leading to filing of the Amended Writ of Summon dated 15 August 2019 The Plaintiff claims that KBBSB and EFSB together with Defendant (3) and (6) jointly or individually involved in unlawful activities with intention to harm the business of the Plaintiff and are involved in giving instructions or had given instructions with the intention to confuse, fake and/or cause changes to documents with intention to confuse the public and the market that Cap Nayati is owned by Defendant (1) when it is not.
In view of the above, the Plaintiff seeks amongst others, an injunction to prohibit the Defendants together with its directors, officers and agents collectively or individually from activities related to infringement of its copyrights; compensations, exemplary and statutory compensations; interests; cost and subsequent reliefs and/or any other reliefs that the honorable Court may deem fit and appropriate.
Financial and Operational Impact The above will not have any financial or operational impact on the Group.
Expected losses to the Group, if any KBBSB and EFSB are exposed to the claims, interests and legal expenses as stated above.
KBBSB and EFSB has appointed a firm of lawyers to act on their behalf.
The Company and its legal counsels are studying and reviewing the claims. The Company will take all necessary steps to vehemently defend against the claims and ensure the rights the Company are protected. Further announcements will be made as and when there are material developments in the case.
