Contents :

On 30 September 2004 Messrs. K.H. Tan Architects (the Plaintiff) served on MBSB Project Management Sdn Bhd (1st Defendant), a wholly owned subsidiary of Malaysia Building Society Berhad (the Company) as well as the Company as the 2nd Defendant (hereinafter collectively referred to as the Defendants) a Summons for an alleged breach of the terms of the Letter of Award entered into between the Plaintiff and the 1st Defendant on 19 August 1998 whereby the Plaintiff was appointed to prepare the schematic designs and the layout plans for the proposed development project on the land held under Lot 365 and 366 No.PT102, PT465 and PT100, Batu Ferringhi Town, Penang. (the Project)


The Plaintiff alleges that the Defendants have failed to make payment of their fees for the services that they have rendered in respect of the Project. As such the Plaintiff has sought for the following reliefs from the Court:-

(a) the sum of RM225,375.00 being the outstanding amount due to the Plaintiff for services rendered;

(b) interest at the rate of 8% per annum on the sum of RM225,375.00 from the date of filing of the Summons until the date of full settlement;

(c) cost; and

(d) such other form of relief that the Court deems fit.

The matter is now fixed for Mention in Court on 19 October 2004.

        The Company does not foresee any financial impact on the group arising from the Summons.
