Mohd Afrizan Bin Hussain, the Liquidator of Wintoni Group Berhad (In Liquidation) ("Company") wishes to announce that the Liquidator of the Company has been served on the 17 October 2017 with a Notice of Application dated 16 October 2017 filed by Cheah Kwong Lee, a contributory of the Company, in relation to Kuala Lumpur High Court Companies Winding Up No. 28NCC-354-06/2017.

The grounds in support of the Notice of  Application, in brief, filed by Cheah Kwong Lee, a contributory, are as follows:-

(1)     that he seek to preserve the Company, its goodwill, its reputation and its assets pending the disposal of the application to set aside and/or stay the Winding Up Order dated 17 August 2017;

(2)     that the application to set aside and/or stay the Winding Up Order is based on alleged procedural irregularities and a bona fide dispute on the debt alleged to be due to the Petitioner;

(3)     that the Liquidator has taken steps in the performance of his duties as liquidator of the Company by making announcement of his appointment to Bursa Malaysia Berhad and will continue to carry out his functions unless restrained by Court.

The date of the Hearing of the Notice of Application has been fixed to be heard on 27 October 2017.

The Liquidator is seeking legal advice from its solicitors.
